Welcome to MoverClaims.com ("Platform," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the MoverClaims.com website and services. By accessing or using our Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using MoverClaims.com, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the Platform.

2. Description of Service

MoverClaims.com provides a claims information management platform that facilitates the collection, organization, and communication of moving-related claims information between Moving Agents and their customers. MoverClaims.com is solely a technology platform and is NOT a moving company, insurance provider, claims adjuster, or party to any claims settlement.

3. User Categories and Responsibilities

3.1 Moving Agents

Moving Agents are moving companies or their authorized representatives who use the Platform to receive and manage claims information from their customers.

Moving Agent Responsibilities:

• Moving Agents are solely and entirely responsible for reviewing, evaluating, processing, and resolving all claims submitted by their customers
• Moving Agents are solely responsible for all claim payments, settlements, denials, and communications with customers regarding claims
• Moving Agents must comply with all applicable federal, state, and local laws and regulations governing moving services and claims handling
• Moving Agents are responsible for maintaining appropriate insurance coverage and liability protection
• Moving Agents warrant that they have all necessary authority and licenses to operate as moving service providers

3.2 Customers

Customers are individuals or entities who have used a Moving Agent's services and are submitting claims information through the Platform.

Customer Acknowledgments:

• Customers acknowledge that MoverClaims.com is NOT their moving company and is NOT responsible for handling, evaluating, or paying their claims
• Customers understand that their claim is submitted to and will be handled exclusively by their Moving Agent
• Customers acknowledge that all claim decisions, payments, and settlements are the sole responsibility of the Moving Agent
• Customers agree to direct all questions, disputes, and communications regarding their claim to their Moving Agent, not to MoverClaims.com

4. Platform Limitations and Disclaimers

4.1 No Claims Responsibility

MoverClaims.com expressly disclaims any and all responsibility or liability for:

• The evaluation, processing, approval, denial, or payment of any claims
• The accuracy, completeness, or validity of claims information submitted through the Platform
• Any disputes between Moving Agents and Customers regarding claims
• The financial capacity of Moving Agents to pay claims
• The quality of moving services provided by Moving Agents
• Any delays in claim processing or resolution
• Any acts, omissions, or misconduct by Moving Agents

4.2 Information Management Only

The Platform serves exclusively as a claims information collection and management tool. MoverClaims.com:

• Does NOT evaluate the merit or validity of any claim
• Does NOT determine claim values or settlement amounts
• Does NOT provide legal advice or claims adjudication services
• Does NOT guarantee any outcome for submitted claims
• Does NOT act as an intermediary in claim disputes

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

MoverClaims.com, its owners, officers, employees, agents, and affiliates shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:

• Use or inability to use the Platform
• Any claim submitted, processed, or handled through the Platform
• Any dispute between Moving Agents and Customers
• Any loss, damage, or injury resulting from moving services
• Delayed, denied, or unpaid claims
• Errors, omissions, or inaccuracies in claims information
• Unauthorized access to or alteration of your data
• Any other matter relating to the Platform or services

6. Indemnification

6.1 Moving Agent Indemnification

Moving Agents agree to indemnify, defend, and hold harmless MoverClaims.com and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Their handling or mishandling of customer claims
• Their failure to pay valid claims
• Their violations of applicable laws or regulations
• Their moving services or operations
• Any disputes with their customers

6.2 Customer Indemnification

Customers agree to indemnify, defend, and hold harmless MoverClaims.com and its affiliates from any claims, damages, losses, liabilities, and expenses arising from:

• False or fraudulent claims information
• Disputes with their Moving Agent
• Misuse of the Platform

7. No Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

MoverClaims.com does not warrant that:

• The Platform will be uninterrupted, secure, or error-free
• Claims information will be transmitted without loss or corruption
• Any particular claim outcome will be achieved
• Moving Agents will fulfill their obligations

8. Relationship Between Parties

8.1 Independent Parties

MoverClaims.com, Moving Agents, and Customers are independent parties. Nothing in these Terms creates any partnership, joint venture, agency, employment, or franchise relationship.

8.2 Direct Relationship

The contractual relationship for moving services and claims handling exists solely between the Moving Agent and the Customer. MoverClaims.com is not a party to that relationship.

9. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of information as described in our Privacy Policy.

MoverClaims.com will make reasonable efforts to maintain the security of claims information but cannot guarantee absolute security of transmitted data.

10. Dispute Resolution

10.1 Claims Disputes

Any disputes regarding claims, claim payments, or moving services must be resolved directly between the Moving Agent and Customer. MoverClaims.com will not mediate, arbitrate, or participate in such disputes.

10.2 Platform Disputes

Any disputes arising from these Terms or use of the Platform shall be governed by the laws of Illinois, without regard to conflict of law provisions. Users agree to resolve disputes through binding arbitration in Lake County, Il, except where prohibited by law.

11. Termination

MoverClaims.com reserves the right to suspend or terminate access to the Platform at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Platform immediately ceases
• You remain bound by obligations that by their nature should survive termination, including indemnification and limitation of liability provisions
• MoverClaims.com has no obligation to retain or provide access to stored claims information

12. Modifications to Terms

MoverClaims.com reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Platform with a new "Last Updated" date. Your continued use of the Platform after such modifications constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MoverClaims.com regarding use of the Platform and supersede all prior agreements and understandings.
